1. Controller

We have not appointed a data protection officer, as the statutory requirements (Section 38 BDSG) do not apply to us.

2. General Information on Processing and Legal Bases
We process personal data only as necessary to provide a functional shop and process orders, or where you have consented. Legal bases: Art. 6(1)(a) GDPR (consent, e.g. non-essential cookies, analytics, newsletter); (b) performance of a contract and pre-contractual measures; (c) legal obligations (e.g. commercial/tax retention); (f) legitimate interests (e.g. secure operation, fraud prevention).

3. Hosting and Shop Platform (Shopify)
Our shop runs on the platform of Shopify International Limited, Victoria Buildings, 2nd Floor, 1–2 Haddington Road, Dublin 4, D04 XN32, Ireland (parent: Shopify Inc., Canada). Shopify provides hosting, shop software and checkout and processes data on our behalf (DPA under Art. 28 GDPR). Transfers to Shopify Inc. (Canada) and sub-processors in third countries may occur; Canada is covered by an EU adequacy decision, otherwise transfers are safeguarded by EU Standard Contractual Clauses (Art. 46 GDPR, see Section 12). Legal basis: Art. 6(1)(b) and (f) GDPR. 4. Server Log Files
On access, server log files are automatically collected (browser type/version, OS, referrer URL, hostname, time, IP address). They serve error-free operation and security and are not merged with other data. Legal basis: Art. 6(1)(f) GDPR.

5. Cookies and Consent Management (Usercentrics)
The shop uses cookies. Technically necessary cookies (e.g. cart, _shopify_*, _secure_session_id) are required for operation and the cart (Art. 6(1)(f) GDPR; Section 25(2) No. 2 TDDDG). Non-essential cookies are only set after your consent. We use Usercentrics (Usercentrics GmbH, Sendlinger Straße 7, 80331 Munich, Germany) to manage consent. Via the cookie banner you can grant, refuse and withdraw consent at any time; your choice controls, through Shopify's consent interface, which scripts load.
Legal basis: Art. 6(1)(a) GDPR with Section 25(1) TDDDG; (c)/(f) for the consent management itself.

6. Order Processing and Customer Account
To process your order we process the data you provide (name, delivery/billing address, email, phone, where applicable company and VAT ID, ordered items, payment data). You may optionally create a customer account. Legal basis: Art. 6(1)(b) GDPR; for retention (c). Retention: Until the contract is fully performed; thereafter per statutory retention periods (in particular Sections 257 HGB, 147 AO – generally 6 or 10 years). A customer account exists until you delete it.

7. Payment Processing
Data required for payment is transmitted to the respective payment service provider, which processes it as an independent controller:
• Shopify Payments (technically via Stripe): Shopify International Limited, Dublin, Ireland;
  processing inter alia by Stripe Payments Europe Ltd., Dublin, Ireland.
• PayPal: PayPal (Europe) S.à r.l. et Cie, S.C.A., 22–24 Boulevard Royal, 2449 Luxembourg.

Legal basis: Art. 6(1)(b) GDPR. Third-country transfers see Section 12.

8. Shipping and Logistics Providers
To deliver your order we pass the necessary address/contact data to the engaged provider: DHL (DHL Group), UPS (UPS Deutschland S.à r.l. & Co. OHG), Kühne + Nagel (Kühne + Nagel (AG & Co.) KG). Legal basis: Art. 6(1)(b) GDPR.

9. Web Analytics: Google Analytics 4
Where you have consented, we use Google Analytics 4 (Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland). It uses cookies to analyse shop usage; IP anonymization is enabled (truncation within EU/EEA). Legal basis: Art. 6(1)(a) GDPR with Section 25(1) TDDDG (consent via Usercentrics) – collection
only after consent in the banner. Retention: [14] months. Withdrawal anytime via cookie settings. Transmission to Google servers, including in the USA, cannot be excluded (see Section 12). https://policies.google.com/privacy

10. Newsletter
If you subscribe, we process your email address to send it. Double opt-in; sign-up/confirmation time and IP address are logged. Unsubscribe anytime via the link. Legal basis: Art. 6(1)(a) GDPR. Processor: [Brevo GmbH, Köpenicker Straße 126, 10179 Berlin] – servers in the EU, DPA under Art. 28 GDPR.

11. Contacting Us
If you contact us by email, phone or contact form, we process your details to handle your request. Legal basis: Art. 6(1)(b) or (f) GDPR. Deleted once no longer required; statutory retention periods remain unaffected.

12. Data Transfers to Third Countries
Transfers to recipients outside the EU/EEA (e.g. Shopify Inc., Canada; Google, USA) occur only where an EU adequacy decision exists (e.g. Canada; EU-U.S. Data Privacy Framework for certified US providers) or appropriate safeguards under Art. 46 GDPR (in particular EU Standard Contractual Clauses) are in place.

13. Your Rights as a Data Subject
You have the right to access (Art. 15), rectification (Art. 16), erasure (Art. 17), restriction
(Art. 18), data portability (Art. 20) and to object (Art. 21 GDPR). You may withdraw consent at any time with effect for the future (Art. 7(3) GDPR). No automated decision-making, including profiling, within the meaning of Art. 22 GDPR takes place. Contact: info@tea-hamburg.de
